dc.description.abstract | The Law nº 32/2006, of 26 July, which regulates assisted reproductive technologies (ART´s) has undergone several significant changes. The most recent legislative change was carried out by Law nº 72/2021, of 12 November, which now allows the use of post-mortem assisted reproductive technologies techniques, and this is the subject of this dissertation. Post Mortem ART´s has always been a subject that has generated a lot of controversy, for fear of jeopardising the fundamental rights of both the child who would be born through the use of such techniques and the deceased father. Before de amendment introduced by Law nº 72/2021, there were several legal issues that needed to be resolved in relation to post- mortem ART´s. We are referring to the lack of establishment of inheritance effects resulting from the application of these reproductive techniques, the absence of a time limit for carrying out the techniques, as well as the imprecise way of accessing them. However, with Law nº 72/2021, these aspects have been resolved and paternity is now established in relation to the deceased father and the child born through these reproductive practices benefits from a general inheritance capacity. A time limit is set for the realisation of post- mortem assisted reproductive technologies, contributing to greater legal certainty and security. With regard to access to these techniques, express consent from the deceased is required and, as such, it is important to analyse whether the child will also be considered the child of the deceased father and will benefit from full inheritance rights, even if the deceased did not consent to the techniques. It is also important to find out whether there are any legal consequences for those who use reproductive techniques without this consent. In this study, the legal aspects introduced by the new law will be analysed and, whenever possible, a reasoned opinion will be drawn up about them. | eng |
dc.description.abstract | A Lei n.º 32/2006, de 26 de julho, que regula a procriação medicamente assistida (PMA), foi alvo de várias mudanças significativas. A mais recente alteração legislativa foi levada a cabo pela Lei n.º 72/2021, de 12 de novembro, que passou a permitir o recurso às técnicas de PMA post mortem, e será em torno desta temática que a presente dissertação irá incidir. A PMA post mortem sempre foi um assunto que gerou muita controvérsia, pelo receio de serem postos em causa direitos fundamentais tanto da criança que viesse a nascer mediante o recurso a tais técnicas como do falecido pai. Antes da alteração introduzida pela Lei n.º 72/2021, eram vários os aspetos jurídicos que careciam de solução relativamente à PMA post mortem. Referimo-nos à falta de estabelecimento de efeitos sucessórios decorrentes da aplicação destas técnicas reprodutivas, à ausência de um limite temporal para a execução das técnicas, bem como ao modo impreciso de acesso às mesmas. Contudo, com a Lei n.º 72/2021 estes aspetos referidos supra foram alvo de solução e desta forma, passa a haver o estabelecimento da paternidade relativamente ao falecido pai e a criança nascida através destas práticas reprodutivas beneficia de uma capacidade sucessória geral. É fixado um limite temporal para a realização da procriação medicamente assistida post mortem, contribuindo para uma maior certeza e segurança jurídica. Relativamente ao modo de acesso a estas técnicas, torna-se necessário um consentimento prestado de forma expressa pelo falecido e como tal, importa analisar se a criança será de igual forma considerada filha do falecido pai e se beneficiária de plenos direitos sucessórios, mesmo que não tenha havido o consentimento do falecido para a realização das técnicas. Importa ainda averiguar se há alguma consequência jurídica para quem recorre às técnicas reprodutivas sem esse devido consentimento.Neste presente estudo, os aspetos jurídicos introduzidos pela nova lei serão analisados e sempre que possível será elaborada uma opinião fundamentada acerca dos mesmos. | por |
