Abuso sexual de crianças : aspectos jurídicos a ponderar no âmbito da perícia médico-legal

Abstract

A presente dissertação insere-se no domínio da Medicina Legal e Ciências Forenses e trata da abordagem de abuso sexual de crianças visando explicitar a realidade dos menores de catorze anos, nos termos do art.º 171 do Código Penal1, no âmbito da perícia médico-legal. Neste sentido, foi utilizada uma amostra de 138 relatórios, provenientes de perícias, de natureza sexual relativos a um período de 5 anos (2004-2008), cuja informação transcrita foi feita através de uma ficha, semelhante a um questionário. O estudo apresentou algumas dificuldades no levantamento de dados visto que muitos dos relatórios quase nada ou nada tinha sobre os factos, se existisse mais informação, a abordagem jurídica poderia ter sido mais relevante. Embora o tema seja delicado e complexo, nomeadamente pela ausência de sinais objectivos de práticas sexuais, não significa que o abuso sexual não possa ter ocorrido, visto que num grande número destas situações não resultaram vestígios, o que constitui um inevitável desafio.

The present thesis is set in the field of legal medicine and forensic sciences and deals with the approach to the sexual abuse of children with the aim to clarify the situation of children less than 14 years in terms of article 171 of the Penal Code, within the scope of medico-legal expertise. In this way, a sample of 138 reports of sexual nature was used, spanning a period of 5 years (2004-2008), and provided by experts whose written information was gathered from a file, similar to a questionnaire. The study presented certain difficulties in the extraction of data considering the many reports had almost nothing or included nothing on the facts, if more information existed, the legal approach would have been more relevant. Even though the topic is delicate and complex, in particular the absence of objective signs of sexual practices, does not mean that sexual abuse has not occurred, considering in a number of situations there are no signs, which constitutes an inevitable challenge.
