O direito à assistência e ao convívio familiar na velhice

Abstract

O presente estudo tem como escopo tratar sobre os reflexos do envelhecimento populacional nos indivíduos que estão a vivenciá-la, os obstáculos enfrentados neste processo e as necessidades a serem supridas sob a perspectiva legal. O foco principal se direciona ao idoso que sofre uma maior vulnerabilidade, podendo levá-lo a um estágio de pobreza. Será abordada a necessidade de fornecimento de suporte para os familiares socorrerem os seus idosos quando estes demandarem por cuidados. A família deverá exercer a solidariedade entre seus membros, concomitantemente a esta, deverá haver a solidariedade estatal exercendo a sua função assistencial, promovendo a união familiar e proporcionando as condições necessárias para um bem-estar social, através de serviços e benefícios existentes e geridos pela Segurança Social. ABSTRACT The present study aims to approach the consequences of population ageing in individuals who are experiencing it; the obstacles faced in this process and the necessities to be fulfilled from a legal perspective. The main focus is directed to the elderly in vulnerability that could lead to a poverty stage. It will be adressed the legal issues that need modifications to make it possible that the family members are the first to help their elderly when special care is demanded. The family should exercise solidarity among its members, and concurrently with this, there must be state solidarity exercising its assistance function by promoting family unity and providing the necessary conditions for social welfare, through the existing services and benefits managed by Social Security
