Os Princípios da Transparência e da Abertura como Garantias de Legitimidade Democrática da União Europeia

Abstract

O propósito desta dissertação será analisar a forma como os princípios da transparência e da abertura, dogmaticamente relacionados, são efectivados no seio da UE, e que efeitos práticos positivos e negativos advêm desse quadro institucional. Logo, existirão aqui duas preocupações fundamentais: expor os institutos que visam concretizar estes valores, e analisar criticamente as finalidades governativas que são ou poderiam ser alcançadas. A tese defendida será a de que a transparência e a abertura serão indispensáveis para uma completa legitimidade de actuação da União. Este ponto será defendido através de uma análise das características fundamentais da UE que justificam essa necessidade de legitimação, do enquadramento dos conceitos propriamente ditos e do porquê da sua importância estratégica, e dos pontos positivos e negativos do regime jurídico da União que os tutela.A UE é uma organização interestadual de características especialmente peculiares, sendo as mais relevantes talvez a sua transversalidade e o avançar paulatino para uma posição de importância geoestratégica cada vez maior. Ao mesmo tempo que percorre o caminho de afirmação global, a União terá também de lidar com os tumultos internos que ameaçam a sua legitimidade interventiva que, em certos momentos históricos, pareceu inquestionável.O propósito será analisar esta problemática de um ponto de vista muito mais delimitado, concentrando a análise numa via específica para atenuar esta tendência preocupante para quem acredita nos benefícios do projecto europeu. Diagnosticando um dos males mais prementes da União como a dificuldade em penetrar materialmente no núcleo substantivo de intervenção da UE, de modo a compreendê-la e perceber as suas rotinas, será defendida a tese de que a transparência e a abertura da UE é fundamental para os propósitos descritos.

The purpose of this dissertation is to analyse the way the principles of transparency and openness, dogmatically related, are made effective within the EU, and what practical effects, positive and negative, come from that institutional frame. Therefore, there shall be two fundamental concerns: to expose the institutes that materialize these values, and to critically analyse the governmental goals that are or can be achieved. The thesis here defended is that transparency and openness are indispensable to a complete legitimacy of the Union’s performance. This point shall be defended through an analysis of the fundamental characteristics of the EU that warrant such a need for legitimacy, of the framework of the concepts and of the reasoning behind its strategic importance, and of the positive and negative points of the legal regime in which the EU safeguards them.The EU is a multi-state organization of especially peculiar characteristics, the most relevant being perhaps its transversality and the slow advancement to a position of estrategic importance that grows to become bigger and bigger. At the same time that it goes through the path of global standing, the Union will also have to deal with internal problems that threaten its legitimacy to intervene which has, in some historical moments, appeared inquestionable.The purpose shall be to analyze this issue from a much more detailed point of view, focusing the analysis on a specific path towards solving this worrying trend for those who believe in the benefits of the european project. After diagnosing one of the most serious problems of the EU, in order to understand it and its roots, one must defend the thesis that transparency and openness are essencial to the described objectives.
