As Responsabilidades Parentais Num Novo Sistema Familiar das Sociedades Contemporâneas: as Famílias Recombinadas

Abstract

As mudanças sociológicas ocorridas ao longo dos tempos modernos provam a importância do Direito da Família, ramo do direito que mais sofre com as transformações sociais. Este exige um constante estudo e aperfeiçoamento, de modo a percorrer um caminho que vá ao encontro do interesse das famílias e as proteja. Revela-se então um tema bastante exigente em razão dos impactos sociais que provoca no núcleo familiar. A crescente existência de novas formas familiares com base nos afetos, nomeadamente das famílias recombinadas, exige um estudo aprofundado sobre as novas figuras familiares de Padrasto e Madrasta, o seu papel na relação com os filhos do cônjuge ou companheiro ─ os filhos do divórcio ─ e sobre como se relacionam estas novas figuras familiares com as Responsabilidades Parentais. O superior interesse da criança deve ficar sempre salvaguardado, designadamente em situações de dissolução matrimonial nas quais se exige a regulação das responsabilidades parentais porque, por vezes, os progenitores não são capazes de as exercer. Importa o estudo das Responsabilidades Parentais, assunto de cariz sensível e tratado de forma respeitosa pelo legislador ao longo dos tempos. Assim, com um olhar crítico e jurídico, pretende-se a realização de um estudo aprofundado quanto às Responsabilidades Parentais e a sua inserção nesta nova fisionomia familiar, analisando a interacção do Direito com esta actual realidade social. No que concerne a esta recomposição familiar sabemos que envolve uma grande complexidade, uma vez que há complexos relacionamentos entre progenitores; filhos; atuais cônjuges/companheiros e, por vezes, também os filhos dos atuais cônjuges/companheiros.

The sociological changes that have occurred throughout modern times prove the importance of Family Law, which is the branch of law that suffers most from social transformations. It requires constant study and refinement in order to take a path that is in the interest of families and protects them. This proves to be then a very demanding subject because of the social impacts that it causes in the family nucleus. The increasing existence of new family forms, based on affections, especially recomposed families, requires a rich study of the new family figures of Stepfather and Stepmother and their role in the relationship with the children of the spouse or partner ─ the children of divorce ─ and how Parental Responsibilities relate to these new family figures. The best interest of the child should always be safeguarded, even in situations of marital dissolution, which require the regulation of parental responsibilities because sometimes the parents are not able to exercise them. In this way, it is important to study Parental Responsibilities, an issue that is sensitive and treated in a respectful manner by the legislator over time. Then, with a critical and judicial view, we intend to carry out in a deep study on Parental Responsibilities and their insertion in this new physiognomy family, analyzing the interaction of Law with this current social reality. Recomposed Families involve a great complexity, since there are complex relationships between parents, children, actual stepfather/stepmother, and sometimes also stepfather/stepmother’s children.
