A Gestação de Substituição: Do Sonho à Inconstitucionalidade

Abstract

Vivem-se novos tempos, novas possibilidades. Com o avançar dos anos, torna-seimportante perceber de que forma a evolução geral da humanidade interfere com um dosfenómenos cada vez menos naturais da nossa génese: o nascimento.Sempre cientes do carácter problemático da Gestação de Substituição, abraçamosesta temática com o objetivo de se perceber o porquê de esta forma alternativa de gerar umacriança invadir tão abruptamente as esferas jurídica, médica, social e ética, entre outras,tendo sempre o principal foco o nosso Ordenamento Jurídico.Para tal será importante, numa fase inicial, tentar esmiuçar os contornos do tema, deforma a ter total conhecimento do que realmente se trata esta técnica. Numa segunda faseanalisaremos o desenvolvimento da Gestação de Substituição, desde o início do séc. XX atéà atualidade: procuraremos abordar o seu progresso, desde o tempo em que não passava deuma mera especulação, aos tempos em que foi veemente reprimida, rematando com a análiseda época em que esta foi, entre nós, uma prática legal.Finalmente, faremos uma análise crítica ao que foi dito e feito pela Gestação deSubstituição em Portugal no confronto com os preceitos constitucionais, sempre com o foconaquele que pode definir-se como principal objetivo desta Dissertação: reformular, a partirda Declaração de Inconstitucionalidade do Acórdão do Tribunal Constitucional com o n.º225/2018, a Lei da Procriação Medicamente Assistida, de forma a que a Gestação deSubstituição seja novamente uma realidade em Portugal.Márcio Serafim Ribeiro Teixeira, Universidade de Coimbra, 2019

As the years go by, it becomes important to realizehow the general evolution of humanity interferes with one of the less natural phenomena ofour genesis: the birth.Always aware of the problematic nature of the Surrogate Motherhood, we embracethis theme in order to understand why this alternative way of generating a child soabruptly invades the legal, medical, social and ethical spheres, among others, alwayshaving the main focus in our Legal Order.To do that, it’ll be important, at an early stage, to try to scrutinize the contours ofthe subject, in order to have full knowledge of what the technique is really about. In asecond phase we will analyze the development of the Surrogate Motherhood, from thebeginning of the 20th century to the present: we will try to approach its progress, from thetime when it was nothing more than a speculation, to when it was vehemently repressed,ending with the analysis of when it was a legal practice among us.Finally, we will make a critical analysis of what was said and done by theSurrogate Motherhood in our country, in the confrontation with the constitutionalprecepts, always with the focus on what can be defined as the main objective of thisDissertation: to reformulate the Law of Medically Assisted Procreation, to turn theSurrogate Motherhood in a legal practice again, starting from the Declaration ofUnconstitutionality of the Judgment of the Constitutional Court with the number 225/2018.Márcio Serafim Ribeiro Teixeira, Coimbra University, 2019
