CARTOGRAFIA DA RELAÇÃO ENTRE OS TRIBUNAIS E OS MEIOS DE COMUNICAÇÃO SOCIAL NO BRASIL: Uma experiência na Bahia

Abstract

A presente dissertação analisa a natureza da relação entre os media de informação e os tribunais e o seu impacto na construção e consolidação da Democracia. Adotando uma perspectiva interdisciplinar, e recorrendo a entrevistas, examinam-se várias dimensões dessa relação, problematizando as suas implicações para o exercício da cidadania. Tomando como caso de estudo o Tribunal de Justiça da Bahia e os principais meios de comunicação social do estado, procurou-se responder questões sobre a relação da Justiça com o Jornalismo, os problemas concretos e prementes ali existentes, e suas implicações. Também se enfrenta o dilema do direito à informação e liberdade de expressão diante dos limites de publicidade que reclamam os processos na Justiça e a postura dos magistrados diante do papel de julgador, bem como a pressão da opinião pública e a nova realidade produzida com as polêmicas transmissões ao vivo e por vídeo das sessões de julgamento. Mergulhou-se em temas inerentes ao Poder Judiciário e aos meios de comunicação social como a linguagem, a noção temporal, a ausência de fonte, a formação acadêmica dos jornalistas, as amarras legais que impedem manifestações dos juízes fora dos autos e a participação de outros atores do sistema de Justiça na esfera pública. Neste contexto, mereceu atenção destacada a cobertura jornalística dos processos criminais: a criação de narrativas próprias, a espetacularização, o sensacionalismo, as disputas pela legitimidade na esfera pública, a busca pela melhor audiência a qualquer custo, o pré-julgamento. Ao final da investigação, são apontadas saídas diante dos problemas comuns a ambas as instituições.

This dissertation analyzes the nature of the relationship between the information media and the courts and their impact on the construction and consolidation of Democracy. Adopting an interdisciplinary perspective, and using interviews, various dimensions of this relationship are examined, questioning its implications for the exercise of citizenship. Taking the Bahia Court of Justice and the state's main media as a case study, sought to answer questions about the relationship between Justice and Journalism, the concrete and pressing problems that exist there, and their implications. There is also the dilemma of the right to information and freedom of expression with regard to the limits on publicity about the cases and the posture of the magistrates in their role as judges, as well as pressure from public opinion and the new reality produced by the controversial live and video broadcasts of the trial sessions. Themes inherent to the Judiciary and to the media such as language, the notion of time, the absence of a source, the academic training of journalists, the legal constraints that prevent positioning by judges outside the proceedings and the participation of other actors of the justice system in the public sphere have been covered in depth. In this context, the journalistic coverage of criminal cases deserved special attention: the creation of their own narratives, spectacularization, sensationalism, disputes for legitimacy in the public sphere, the search for the biggest audience at any cost, the pre-trial. At the end of the investigation, solutions are pointed out in view of the problems that are common to both institutions.
