As mulheres nas magistraturas: Uma análise das representações sociais

Abstract

Nas últimas décadas, uma significativa transformação das profissões jurídicas tem sido a sua crescente feminização. Se até 1974 a magistratura era uma profissão vedada às mulheres, em 2014, de um total de 1784 juízes/as portugueses/as nos tribunais de primeira instância, da Relação e do Supremo Tribunal de Justiça, 1041 são mulheres (58%). Estes números, bem como o crescente protagonismo de algumas magistradas, têm suscitado o interesse da comunicação social e de alguns setores do judiciário que promovem debates internos sobre o tema. Contudo, enquanto noutros países podemos encontrar estudos sobre esta realidade, em Portugal esta é uma análise ainda não realizada, pelo que a interpretação relativa à feminização do judiciário assenta, não raras vezes, em especulações e, não raras vezes, em ideias estereotipadas. Procurando contribuir para o preenchimento desta lacuna na investigação sociojurídica, o objetivo geral deste artigo passa por conhecer as representações por parte da sociedade relativamente ao papel das mulheres no sistema de justiça portuguesa.

In recent decades, increasing feminization caused a significant transformation of legal professions. If until 1974 the judiciary was a profession forbidden to women, in 2014, in a total of 1784 judges, 1041 were women (58%). These numbers, as well as the growing role of some female magistrates, have raised the interest of the media and even of some judicial sectors which have promoted internal debates on the issue. However, whereas in other countries we can find several studies on this field, in Portugal analysis is still scarce. As a result, the social interpretation on the feminization of the judiciary is based mainly on speculation and often on stereotyped ideas. Seeking to contribute to fill this gap in sociolegal studies, the purpose of this paper is to look into? the social perceptions on the role of women in the Portuguese legal system.
