Título: | Tal como aconteceu noutros domínios jurídicos, o direito de preferência também foi salvaguardado pelo legislador em matéria de arrendamento. É o artigo 1091.º/1-a) do Código Civil português que confere ao arrendatário a faculdade de exercer o direito de preferência em relação ao local arrendado, sempre que o mesmo seja objeto de transmissão onerosa. Assim, sempre que tenha a intenção de proceder à alienação do prédio a um terceiro, o senhorio deverá dar primazia ao arrendatário sempre que este tenha interesse em celebrar o negócio.
