Auxílios de Estado no Terceiro Setor social: “O privilégio humano sob o mercado”

Abstract

The main focus of this dissertation is the granting of State aid to the Third Social Sector. Therefore, we set out to a field analysis, in which some institutions were surveyed in order to understand their impact on the national institutional framework. The subject of our investigation has acquired relevance and attention from doctrine and jurisprudence, in particular following the legal agreement of the Tribunal da Justiça Casa di Risparmio di Firenze, in which the Court asks whether there is a possibility of aid, attributed to a "social enterprise", distort or forge the competition.. In addition, the erudite Court considered an enterprise as any entity that pursues an economic activity, regardless of its legal status and financing method. Doing so, it became possible to fit the Third Sector in the notion of company, when it acts in the Market as an economic agent. Internally, the European Commission was instigated by a company with the same social purpose, to decide on the possibility of granting a financial benefit to Santa Casa de Misericórdia de Tomar that could distort the competition. Considered too, in this spacial case, that aid stat had a purely local effect and was therefore not liable to distort or forge the competition. Valuing locally the public interest pursued by the Third Sector institutions, to the detriment of the mercantilist interests of the Second Sector institutions. The same as writing, from the for-profit marketAlthough incipient, in the future, with the growth of the Social Economy sector, the decisions about this thematic may diverge. Hence, it is of substantial utility to emphasize this emerging issue now that it was concluded that the State aid allocated to the institutions surveyed, in their extent, are not sufficient to make the Third Sector more competitive and sustainable.

A presente dissertação tem como primordial desiderato a concessão de auxílios de Estado ao Terceiro Setor Social. Daqui, partiu-se para a análise de Campo, onde se inquiriram algumas Instituições, por forma a compreender o impacto destes no quadro institucional nacional. O objeto da nossa investigação foi adquirindo relevância e granjeando a atenção da doutrina e da jurisprudência, nomeadamente, após o acórdão do Tribunal da Justiça (TJ) Casa di Risparmio di Firenze, onde o Tribunal é chamado a questionar a possibilidade de um auxílio, atribuído a uma “empresa social”, distorcer ou falsear a concorrência. Além disso, o douto tribunal entendeu por bem considerar como empresa qualquer entidade que prossiga uma atividade económica, independentemente do seu estatuto jurídico e do seu modo de financiamento. Abrindo portas para se enquadrar, para este efeito, o Terceiro Setor na noção de empresa, quando atua no Mercado com as vestes de agente económico. Internamente, também a Comissão Europeia foi instigada, por uma empresa com o mesmo objeto social, a pronunciar-se sobre possibilidade da concessão de um benefício financeiro à Santa Casa de Misericórdia (SCM) de Tomar poder distorcer a concorrência. Entendeu que, no caso concreto, o auxílio tinha incidência meramente local, pelo que, não era suscetível de falsear a concorrência. Este auxílio valoriza localmente o interesse público prosseguido pelas instituições do Terceiro Setor, em detrimento, dos interesses mercantilistas das instituições do Segundo Setor. O mesmo que escrever, as que prosseguem fins lucrativos.Ainda que incipiente, no futuro, com o crescimento do setor da Economia Social poderemos ter decisões divergentes, sobre a temática. Destarte, apresenta-se de substancial utilidade dar ênfase a este assunto emergente por se ter concluído que os auxílios de Estado atribuídos às Instituições inquiridas, compreendidos na sua extensão, não são suficientes para tornar o Terceiro Setor mais competitivo e sustentável.
