Direito à Cidade Sustentável sob a perspectiva do Direito à Dignidade da Pessoa Humana

Abstract

O presente estudo tem por finalidade analisar o perfil do direito à cidade sustentável sob a perspectiva do direito à dignidade da pessoa humana, tendo como referência a sustentabilidade ambiental como fator preponderante para a garantia do princípio, bem como da sadia qualidade de vida. Assim, percebe-se que a existência do equilíbrio entre esses direitos depende diretamente da presença de um ambiente sociojurídico, uma legislação que garanta tais direitos, a função social da propriedade e da cidade, a participação democrática da sociedade, o meio ambiente ecologicamente equilibrado, serviços públicos urbanos adequados, moradia digna, entre outros. Através desse cenário, em que a população urbana é a maior parte no planeta Terra, se torna indispensável o planejamento urbano mediante leis que organizem a utilização dos espaços e, também, que tragam a dignidade de vida. Portanto, o Direito se torna uma necessária ferramenta pela efetivação plena do direito à cidade sustentável como garantia a dignidade à vida das pessoas no espaço urbano. Diante disso, a importância de uma política democrática com maior atuação dos cidadãos, se torna cada vez mais indispensável, principalmente no que tange a fiscalização e cobranças aos governantes escolhidos, portanto, busca-se cristalizar a desburocratização das ferramentes do acesso ao Direito a cidade sustentável, de forma plena e eficaz, objetivando a motivação da população em ser interessar cada vez mais pelo respeito ao princípio da Dignidade da pessoa humana nos espaços urbanos.

The purpose of this study is to analyze the profile of the entitlement to sustainable city from the perspective of the entitlement to the dignity of the human being, having as reference environmental sustainability as a preponderant factor for the guarantee of the principle as well as the healthy quality of life. Thus, the existence of a balance between these entitlements directly depends on the presence of a socio-legal environment, a legislation that guarantees such rights, the social function of the property and of the city, the democratic participation of society, the ecologically balanced environment, suitable urban public services, decent housing, among others. Through this scenario, where the urban population is the greater part of the Earth planet, urban planning becomes indispensable through laws that organize the use of spaces and also that bring dignity of life. Therefore, Law becomes a necessary tool for the full realization of the entitlement to sustainable city as a guarantee of the dignity of citizen's lives in urban space. Given the above, the importance of a democratic policy with greater citizen participation becomes more and more indispensable, especially as regards the supervision and collection of the elected officials, therefore, the aim is to crystallize the reduction of the tools of access to the Law of the City sustainable, full and effective, aiming at the motivation of the population to be increasingly interested in respecting the principle of the dignity of the human person in urban spaces.
