O NOVO ESTATUTO DOS ANIMAIS NO ORDENAMENTO JURÍDICO PORTUGUÊS À luz da Lei nº8/2017, 3 de março

Abstract

RESUMO:A presente dissertação dedica-se à análise crítico-reflexiva sobre o atual estatuto dos animais no ordenamento jurídico Português, introduzido pela Lei nº 8/2017, de 3 de março. Tendo em consideração a evolução histórica da posição do animal, influenciada pelos valores de proteção e cuidado com estes seres vivos, observamos uma tendência para a alteração da sua posição jurídica. Nas páginas que se seguem, vamos analisar se a superação dos animais quanto às coisas, proposta pela lei e, ponderando o bem-estar dos não humanos, é ou não, a melhor solução. Percorrido este caminho, que não é livre de críticas e discussão, sobressai a questão mais importante, isto é: a de defender os animais, independentemente do estatuto que a lei lhes confere. Bearing in mind the evolution of the legal status of animals, influenced by values of protection and care, we observe a tendency towards alteration of the legal treatment of animals. The following pages, analyse whether or not moving beyond a comprehension of animals as “things” (as a legal concept), proposed by the aforementioned law, is the best solution - considering the well-being of non-humans.
